Offshore Incorporation
Labuan, known by few as Asia's best kept secret is an offshore territory off the coast of Sabah and Sarawak, that is under the control of the Federal Government of Malaysia. Not only does Labuan have good banking systems and facilities, a Labuan company pays a corporate tax rate of 3% and is covered by one of the best confidentiality policies in the world. A Labuan company information cannot be found in any public registry. Malaysian legislation was introduced to allow the establishment of transparent business contacts with foreign business owners and acquire the status of Labuan International Business Financial Centre. Foreign investors, who are interested in registering a company should be cautioned against attempting to navigate Malaysia's regulatory bodies without proper legal advice and expert local guidance. ESTATE PLANNING & GENERATIONAL WEALTH TRANSFER
The Australian Securities and Investments Commission estimates that “nearly half” of people in the country die intestate (that is without a Will) while a survey from 2017 found that nearly 60 per cent of parents haven’t made a Will. ​During times of extreme financial hardship, making a Will may seem like the last thing you would want to spend money on. But it is worth investigating whether you need one before discounting this altogether. If you do have assets such as a property, it is worthwhile to ensure that when you pass away, your assets will go to your intended beneficiaries and provides your loved ones with the clarity as to your intentions. A Will drafted without sufficient clarity has led to contested deceased estates between the executors of the Will and the beneficiaries of the estate. Our legal team has many years of experience in devising complex but powerful asset protection strategies for clients ranging from mum and dads all the way to high net worth individuals requiring much more effective wealth protection strategies by using complex instruments such as a testamentary trust.

DECEASED ESTATES
When a person dies, they may have assets that needs to be dealt with formally, before the assets can be transferred to the beneficiaries of the Will (if indeed such a Will exists). The procedure to wind up the deceased estate will depend on what deceased person’s assets are, their estimated value, their location and how they were owned by the deceased before their death. Where an estate has to be administered formally in Western Australia, your solicitor must determine if there exists a valid Will. If there is such a Will, does the Will stipulate the appointment an executor and, if so, is the executor willing, able and willing to act? The answers to these will determine whether the executor of the Will applies for a Grant of Probate from the Supreme Court of Western Australia, or whether the Court should appoint an administrator under Letters of Administration (or Letters of Administration with Will annexed).
