ESTATE PLANNING & GENERATIONAL WEALTH TRANSFER
The Australian Securities and Investments Commission estimates that “nearly half” of people in the country die intestate (that is without a Will) while a survey from 2017 found that nearly 60 per cent of parents haven’t made a Will. During times of extreme financial hardship, making a Will may seem like the last thing you would want to spend money on. But it is worth investigating whether you need one before discounting this altogether. If you do have assets such as a property, it is worthwhile to ensure that when you pass away, your assets will go to your intended beneficiaries and provides your loved ones with the clarity as to your intentions. A Will drafted without sufficient clarity has led to contested deceased estates between the executors of the Will and the beneficiaries of the estate. Our legal team has many years of experience in devising complex but powerful asset protection strategies for clients ranging from mum and dads all the way to high net worth individuals requiring much more effective wealth protection strategies by using complex instruments such as a testamentary trust. When a person dies, they may have assets that needs to be dealt with formally, before the assets can be transferred to the beneficiaries of the Will (if indeed such a Will exists). The procedure to wind up the deceased estate will depend on what deceased person’s assets are, their estimated value, their location and how they were owned by the deceased before their death. Where an estate has to be administered formally in Western Australia, your solicitor must determine if there exists a valid Will. If there is such a Will, does the Will stipulate the appointment an executor and, if so, is the executor willing, able and willing to act? The answers to these will determine whether the executor of the Will applies for a Grant of Probate from the Supreme Court of Western Australia, or whether the Court should appoint an administrator under Letters of Administration (or Letters of Administration with Will annexed). If you are unsure and wish to seek clarity, we would like to invite you to take us up on a free no-obligation initial consultation over the phone or over Zoom. DIGITAL CRISIS & REPUTATION MANAGEMENT
Our digital crisis and reputation management team provides clear, easy to understand and honest legal advice to our clients whenever they face an issue that requires an immediate response. We understand the distress you are under when your individual or business reputation is under attack with malicious content spreading across social media and the broader internet. Crisis management has become an essential part of the digital age, as the speed that information can travel and passed on is staggering. During a digital/online crisis, our key objective is to act as a trusted legal advisor to our clients in identifying perpetrators and the source of the content production, ensuring all non court related legal avenues to remove the content have been taken but should these options fail, our team is able to quickly assemble a defamation law suit against the perpetrators before the courts or file for a court order forcing the perpetrators to remove the content or face harsh penalties. Our team uses cutting edge technology and leverages on our connections with credible news and media agencies to swiftly issue positive content to counter negative perceptions and challenge the credibility of your attackers. We have seen that this strategy has been effective in quickly combating any reputation attacks using narratives crafted and released by us on your behalf.
GOVERNMENT INVESTIGATIONS & CRIMINAL PROCEEDINGS
Our criminal defence lawyers and consultants are adept at handling enquiries in relation to bribery, corporate fraud, money laundering, traffic and other offences that may occur no matter how small. Our legal team has successfully negotiated for dropped charges against our clients. Needless to say, criminal conviction is a life changing event and can take a heavy toll on your mental health, career prospects, your family and friends. From the moment you are charged with a criminal offence, it is crucial to seek experienced legal representation from the moment you are arrested by the authorities. As our lawyers negotiate with the police in a bid to have the charge(s) dropped, you will be kept informed and have a clearly understanding of what is happening at every stage of your case. If the police or the prosecution is determined to follow through with the charge(s), our legal team will represent you in preliminary hearings and should your matter proceed to trial (assuming a not-guilty plea), we will then engage first rate barristers to ensure the maximum chance of an acquittal at trial.
